These Terms of Service (“Terms”) govern your use of Medi Siha (“the App”), part of the Smartvibes family of apps (smartvibes.com.au). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. What Medi Siha is
Medi Siha is a personal health record-keeping tool. It lets you record medications, log doses, set reminders, store a medical history, save prescription, medication and card images, and generate summaries you can share. It is a record-keeping aid only and is not a substitute for professional medical care.
2. Not an official or complete record
Medi Siha holds only your own personal copy of the information you choose to enter. It is not, and is not a substitute for, the official records kept by your doctor, pharmacy, hospital or clinic, and it is not connected to, synced with, or a replacement for any government or official health database — including My Health Record, Medicare or Services Australia records, the PBS, or any hospital, GP or pharmacy system.
The authoritative record of your medications, conditions, allergies and history is the one held by your healthcare providers and those official systems. What you keep in Medi Siha may be incomplete, out of date, or differ from those records. Do not rely on it as your sole or official health record, and always confirm important details with your doctor or pharmacist.
3. Your responsibilities
- You are responsible for the accuracy of the information you enter, and for verifying anything captured by AI before relying on it.
- You are responsible for the security of your device and for any data you choose to export or share.
- You should only record health information and identifiers (such as a Medicare number) that belong to you, or to a person you are authorised to record for — Medi Siha lets you keep records for more than one person (for example, family members).
- Because data is stored on your device, you are responsible for keeping your own backups.
4. Your data, deletion & keeping backups
You own everything you put into the App — medications, doses, medical history, prescription and medication photos, prescriber (doctor) names, patient details and card information. Your data is stored on your device, not on our servers.
Deleting is permanent. Removing a medication, deleting a patient (which erases all of that person’s medications, doses, prescriptions, history and photo), or using “Delete All Data” takes effect immediately and cannot be undone. Because we keep no copy on any server, neither you nor we can recover deleted data unless you exported a backup first.
5. AI scanning, drug lookups & assistant
When you choose to scan or photograph a prescription, medication or card — including a photo you send to the AI Health Assistant — the image is sent to Google’s Gemini AI to read its text, and the result is returned for you to review and confirm. Separately, if “Online drug lookups” is enabled (Settings → Privacy), the medicine name you type or open is sent to public drug databases (RxNorm and openFDA) for name suggestions and official label/interaction information; you can turn this off. AI extraction and label data can be inaccurate; you must check every field (especially dosages and identifier numbers) and confirm medicines with your pharmacist before relying on them. You agree to use scanning only on documents you own or are authorised to capture.
The AI Health Assistant is powered by AI (Google Gemini) and provides general, educational information only. It is NOT a doctor and its answers must not be taken over, or in place of, advice from your doctor or pharmacist. It can be wrong, incomplete or out of date, and it does not provide medical advice, diagnosis or treatment, and is not a substitute for consulting a qualified health professional. Never start, stop, delay or change a medication, or make any health decision, based on the assistant — always confirm with your doctor or pharmacist first. It is not for emergencies; in an emergency, call your local emergency number (000 in Australia). When you use the assistant, your question, a summary of relevant records (medications, conditions, allergies, recent history), and any photo you attach are sent to the AI to make its answers relevant; see our Privacy Policy. You use the assistant at your own discretion and risk, to the extent permitted by law.
Premium features. Some features — including AI scanning, the AI Health Assistant and AI explanations — may require an unlock or subscription, and their availability, inclusions and pricing may change. All features, free or premium, are for information and record-keeping only and are subject to these Terms, including the disclaimer above.
6. Acceptable use
You agree not to use the App to break any law, to record another person’s health information without authorisation, or to reverse engineer, interfere with, or misuse the App.
7. Intellectual property
The App, its branding, and its content (excluding the personal data you enter) are owned by Smartvibes and protected by law. You are granted a personal, non-exclusive, non-transferable licence to use the App. The data you enter remains yours.
8. Service provided “as is”
The App is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that data will never be lost. We may modify, suspend, or discontinue any part of the App at any time. Medi Siha is independent and is not affiliated with Medicare, Services Australia, My Health Record, the PBS, any private health fund, pharmacy, hospital or healthcare provider.
9. Limitation of liability
To the maximum extent permitted by law, Smartvibes is not liable for any indirect, incidental, special, or consequential loss, or for any loss of data or any health outcome arising from your use of, or reliance on, the App. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where liability can be limited, it is limited to the resupply of the App or the cost of resupply.
10. Indemnity
You agree to indemnify Smartvibes against any claim arising from your misuse of the App or your breach of these Terms, to the extent permitted by law.
11. Termination
You may stop using the App at any time and delete your data from within it. These Terms continue to apply to your prior use.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
13. Changes
We may update these Terms from time to time. The “Last updated” date above reflects the current version; continued use of the App means you accept the updated Terms.
