Terms of Service — SmartList
1. Acceptance of terms
These Terms of Service govern your use of SmartList (“the App”), operated by Smartvibes at smartvibes.com.au. By accessing or using SmartList you agree to be bound by these Terms. If you do not agree, do not use the App.
2. What SmartList provides
SmartList is a grocery-planning app that lets you create weekly grocery lists, track spending and budgets, plan meals and import ingredients, share lists with household members, and scan handwritten or digital lists and receipts. We may modify, suspend, or discontinue any part of the service at any time.
3. Accounts and sign-in
SmartList requires an account to use the app. You can sign in with Google, sign in with Apple, or register with an email address and password. You are responsible for the security of your account and for all activity under it. You must be at least 13 years old to create an account. We may suspend or terminate accounts that violate these Terms.
4. Ownership of your data
You own all content you create — your lists, items, meal plans and notes. You grant us a limited licence to store and sync this data solely to provide the service to you. We do not claim ownership of your data and never use it for advertising. You can export or delete your data at any time via Settings → Data Management or Settings → Account → Delete Account & All Data.
5. Subscriptions and payments
SmartList offers an optional paid “Premium” subscription that unlocks features such as item photos and AI scanning. Premium is billed through your Apple App Store or Google Play account at the price shown at the time of purchase. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription in your App Store or Google Play account settings — uninstalling the app does not cancel it. Except where required by law (including the Australian Consumer Law), payments are non-refundable, and refunds are handled by the app store under its own policies.
6. Household sharing
When you share a grocery week with another user, that user can view and edit that shared week. You remain the owner and can remove members at any time. You are responsible for who you invite. Shared access does not give members access to your other lists or account settings.
7. Acceptable use
You agree not to use SmartList to violate any laws, harass or harm other users, attempt to access other users’ data without authorisation, reverse engineer or extract source code, or use the service for any commercial purpose without our consent.
8. Service provided as-is
SmartList is provided “as is” without warranties of any kind. We do not guarantee the service will be uninterrupted, error-free, or that data will never be lost — please use the export feature regularly to back up your data. Scanned results, prices and store information may be inaccurate and should be verified. SmartList is an independent app and is not affiliated with Woolworths, Coles, Aldi, Costco, or any other retailer.
9. Limitation of liability
To the maximum extent permitted by Australian law, Smartvibes is not liable for any indirect, incidental, special or consequential damages arising from your use of SmartList. Our total liability for any claim shall not exceed the amount you paid for the app (if any) in the twelve months preceding the claim. Nothing in these Terms excludes rights you have under the Australian Consumer Law.
10. Termination
You may stop using SmartList at any time and delete your account via Settings → Account → Delete Account & All Data. We may suspend or terminate your access if you violate these Terms. Data deletion follows the process described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
